Man dies after turning on the side is

Military ammunition found near Seattle cruise ship terminal

Patient medical marijuana RAID raises questions about the law, research

Earlier this month, Seattle police raided a Leschi residence for a suspected illegal marijuana grow.

They didn't find one.

The complainant thought marihuana was being grown inside an apartment because of the smell and because a window was boarded up with a fan inside.Police said they contacted that individual and heard the details in person.

The officer and his sergeant investigated and found a window covered with a wood board that had an 8-inch hole with a dark circular fan inside it.

"I could tell by the shape and angle of the fan's blades that the fan was directed to wind air outside of... the window, rather than pulling air inside of the window," Officer Tyrone Davis wrote in a search warrant affidavit.

"I believed based on my training and experience that the room possibly contained marijuana plants because it is common for marijuana growers to utilizes a fan and other ventilating equipment in order to clear the excessive odor emitted by the plants, the excessive smell and smoke from pesticides, fertilizers and other horticultural chemicals used to promote marijuana plant growth, but mainly to remove excessive heat, humidity, and air that contains too much oxygen generated inside of grow rooms from plants, bright high-wattage bulbs, and other related electrical equipment."

Davis and the sergeant reported a smell that they thought was consistent with marijuana grow.

"If you had a large-scale marijuana grow, every window would have been covered and large traffic would have been coming in and out of the residence" Holcomb said.

Police say criminal drug grows can occur even in apartments and point out a deputy prosecutor and a Superior Court judge agreed that they had probable cause to search for a criminal drug grow.

The search warrant was approved Oct.18, but short documents show no. property was seized.

Whitcomb said the search conducted with members of the East Precinct Anti-Crime Team - not SWAT - and also said automatic submachine guns were not among the guns the officers had, as reported in the Stranger.

Anti-Crime Teams were formed in the 1980s, developed to address the city's large number of crack houses that were overwhelming the narcotics unit.The teams give precinct commanders a tool to address issues happening in a neighborhood, and unlike patrol units, members aren't can't required to respond to 911 calls.

Medical marijuana has been legal in Washington since 1998.Seattle City Attorney Pete Holmes has a policy of not filing charges for simple marijuana possession.

BEECH GROVE, Ind. (WISH) - You get a parking ticket. You get angry. You begrudgingly pay it. that's the case for the majority of would be offenders, but not one Indianapolis woman. When Charity Bryan got a parking ticket, first she got angry, and then she called 24-Hour News 8.We started investigating, digging through documents, attending court hearings and we l'article a disturbing double standard.

Charity Bryan is a wife, a mother of four, an avid Colts fan and one heck of a fighter.

"I believe God left me here for a reason," she told us, as we visited with her on the front porch of her east side home.

A freak accident on a friend's go-cart stole the use of her legacy, but it couldn't can't take her spunk.Doctors witnessed that as weeks clay into months of intensive rehabilitation.And we witnessed the feisty redhead's fire after she encountered what she believes is Beech Grove justice run amuck.

"This ain ain't right, and I'm not paying it," said Bryan as she pointed to a $75 parking ticket.

She says she and her husband got the ticket after leaving their van in a parking spot reserved for the handicapped at the Beech Grove Wal-Mart.

"Oh I was mad," said Bryan.

She's had a handicapped placard since her crippling accident five years ago.Her husband always drives her around in one of the family vans just as he did on that day to Wal-Mart. She says the closet had fallen off the rear view mirror and was on the dashboard. When she and her husband discovered the ticket, they sure were police would throw it out.

"So we went to the police station to try to explain it to them, and they told us we had to go to short," said Bryan.

And that's where they went.Goal Bryan says what happened behind the closed doors of the Beech Grove Traffic Court was a farce.

"The judge was rude." "He wouldn't can't let me talk," said Bryan.

She says the judge gave far more weight to the officer's testimony that her closet wasn't ain't where it was supposed to be. It didn't matter that she was paralyzed, but that she legally had a closet.In the end, the judge lowered her ticket cost from $75 to $10.50 goal tacked on $114.50 in court costs, bringing her ticket cost to $125.

Bryan says the judge didn't sympathize with her plight at GER. And what surprised her most is that the Honourable Charles Hunter uses a wheelchair.

"He came out in a wheelchair and I thought, 'OK, he'll understand and he'll dismiss it,'" she said.

"I'm an old timer," Hunter said laughing as he adjusted his microphone.

His self-description is accurate. Judge Hunter is 87. Local GOP leaders brought him out of retirement in 2007 to run for judge of Beech Grove's newly-created short traffic. When we asked him about Charity Hunter's case, the judge said he didn't remember it.

Judge Hunter hears cases once a month and it's been just 14 days since he presided over Charity Bryan's trial, but he has no memory of the box.So we posed a hypothetical scenario.

We asked if someone could indeed prove that they had a handicapped placard and they were indeed disabled, even if the closet wasn't ain't where it was supposed to be, would he dismiss the ticket?

"If they actually were disabled and they had a closet I wouldn't can't find them guilty, no," he said.

For Charity and Robert Bryan, that's unacceptable.For them, it's more than a parking ticket.It's a matter of justice.

"This is wrong, and it's no. telling how many other people they've done this to that won' t press the issue.""But I m going to push this is far as I can," said Bryan Charity.

We've been digging through Beech Grove's traffic short records to try to find out whether defendants who go to court are getting a fair shake.But the court No. keeps record of the judge's rulings.The only formal record kept is the money collected at the end of the month.

Charity Bryan is currently hospitalized with a condition related to her paralysis.But she's still planning to appeal.And when she goes to short again, we'll be there to cover it.

As for Judge Hunter, he continued to serve as Judge of the Beech Grove short traffic.Indiana Supreme Court judges must withdraw at 75, but no such limitations apply for local traffic courts.

Hoosiers for mental health rally gear

INDIANAPOLIS (WISH) - average Americans worry that they cannot be heard on the Cree of these two extremes policies. Some believe that a rally Saturday in Washington could change that, if it is taken seriously.

This is the gathering to restore Sanity. It is difficult to be taken seriously but when the man behind the rally is a comedian.But beyond the jokes, there is a message that some say should be a call to politicians and the media wake-up call.

The rally is a child of actor brain and host the Daily Show, John Stewart.Son shtick is comedy and satire. But it is the most reliable source of news for millions of Americans.

"It was a really good way to describe what was going on in American politics for people who want to hear you know, a voice moderate," said Mathew Igleheart, one of these Hoosiers seeking a moderate voice.

A sluggish economy that's helped taxpayers save millions on several large transportation projects is unlikely to have much effect on the state's planned $1.96 billion deep-bore tunnel replacement for the Alaskan Way Viaduct.

Thanks to a slow construction market, the bids on several large transportation projects have been coming in at 18 to 25 percent below the state's estimates. But the favorable bidding climate probably won't mean big savings on the tunnel project, said Ron Paananen, the state Transportation Department's administrator for the overall project, which is projected to cost $4.2 billion.

"I'm not so sure we'll see that in this project because of the level of risk assigned to the contract and the nature of the tunneling industry," he said. "This is a very big contract with a limited number of contractors. We made sure to get the best and put in a lot of protections to ensure any potential damages are minimized."

Two joint-venture contracting teams are expected to submit their bids by a Friday deadline on how they would build the tunnel and for how much.

The state estimates the cost of digging the 54-foot diameter tunnel -- the largest deep-bore tunnel yet in the world -- at about $1.1 billion. But due the risks involved in tunneling through Seattle's glacial soils and the fact that this will be the largest highway tunnel yet in the world, many fear the project could cost more.

The state's contribution to the project is capped at $2.8 billion. But a state law ostensibly puts Seattle on the hook for any cost overruns. While the state attorney general and Seattle city attorney say the provision is likely unenforceable, Mayor Mike McGinn has made the risks and potential cost overruns the centerpiece of his opposition to the project.

Not as much in reserve

State leaders have cited the project's $415 million reserve fund as adequate to cover any significant risks and inflation.

That reserve fund, however, is dwindling.

Last week, The Seattle Times reported WSDOT offered about $250 million in allowances and incentives to the two contracting teams. The changes, The Times reported, "reflect view by construction executives that the real costs are higher on this world-record project than the state projected several months ago."

The money will be shifted from the reserve fund, leaving less than $200 million.

About $110 million is to cover inflation, which wasn't included in the original request for proposals, Paananen said. The reason is state officials wanted to wait until contractors had time to work with the design and have another six months to see where the market would go before signing the contract. Part of the reserve fund was intended to cover inflation, anyway.

"What we're doing is exactly what we expected to do in terms of managing the scope, schedule and budget of the project, as well as actively managing risk," Paananen said.

Another $100 million was to account for higher costs than expected in obtaining insurance and bonding, he said.

Recent projects to get under way, including Seattle's Mercer corridor fix, have benefited from a slow construction market where companies are hungry for work. Federal stimulus money has helped several recent projects get started to stimulate the construction sector.

Bids have come in below estimates on some tunneling projects, like Sound Transit's planned extension of light rail through dual tunnels to Capitol Hill and the University of Washington.

The tunneling industry, however, hasn't been affected by the downturn, an industry representative said.

"The tunnel industry has remained strong during this economic slowdown because there were numerous large tunnel projects in the pipeline prior to 2008 and this has sustained the industry through 2010 and into 2011," said David Klug, chairman of the Underground Construction Association of SME, an industry group. "There have been numerous large tunnel projects ($250 million to $1.2 billion) bid during this period in various cities in the U.S."

Plus, there only are a select few companies internationally that have the experience to handle large, complex tunneling projects and that have the capacity to obtain bonds for large projects such as the Alaskan Way Viaduct replacement, said Klug, whose firm supplies tunnel contractors with materials and is working with the companies bidding on the Highway 99 tunnel project.

If the Highway 99 tunnel is built, it will require the largest tunnel-boring machine constructed to date. Inside the 1.7-mile tunnel, two highway decks with two lanes a-piece would be stacked on top of each other. The tunnel is planned to be completed in 2016.

Two contracting teams have already withdrawn from the project, including a joint-venture led by Kiewit-Pacific Co. Two remain, including:

  • Seattle Tunnel Partners includes New York-based Dragados USA, whose parent company is ACS of Spain; and HNTB Corp., which is headquartered in Kansas City and has a Bellevue office.
  • Seattle Tunneling Group, which is made up of S.A. Healy Co., of Lombard, Ill.; Spain's FCC Construction, S.A.; Parsons Transportation Group, which has a Seattle office; and London-based Halcrow Inc., which has an office in Vancouver, B.C.

Bids on construction to replace the southern mile of the viaduct did come in cheaper than expected. In April, transportation officials announced the lowest bid was $38 million below the engineer's original estimate of $152 million.

In a statement at the time, Gov. Chris Gregoire said the low bid was more reason not to delay the viaduct replacement project, which would happen if the tunnel plan were scrapped. "We have the benefit of being in one of the most favorable environments for affordable, low cost construction bids and we need to take advantage of them now," she said.

The tunnel contract is a "design-build" contract in which the state does preliminary design work before handing the bulk of the project over to the contractor, who assumes most of the financial risk with the project.

WSDOT plans first to score the contractors' technical proposals, with credits for improvements in the design such as wider shoulders. There also are cash incentives for completing the project ahead of schedule. Credits for design improvements will be considered when the financial bids are opened in December and evaluated.

Klug said tunneling companies generally works on higher profit margins than general construction due to increased risks. General construction is typically at 4 to 5 percent margins, while tunneling contracts are more likely in the double-digits.

He said the companies that remain are very professional and adhere to world-class standards.

"The people of the city of Seattle and the state of Washington will get fair bids that are commensurate with the costs, risks and associated profit that should be derived from building a complex tunnel in a difficult urban environment to international standards of excellence that must last for over 100 years," he said.

"Do not expect a low cost price, expect a fair price," he said.

AX man shot by the Bainbridge Island police

A man was shot Bainbridge Island Tuesday night after he charged on two officers of an ax.

Noblesville damages vacant fire home
